These terms are the agreement between you and Eider Health for using the app. We've kept them plain. The most important thing to know: Eider helps you keep and share health records, but it is not a medical provider and does not give medical advice.
01What Eider is
Eider is a personal health record tool for families and individuals. It helps you log symptoms, track medications, organize appointments, share information with caregivers, and manage your own health records through Eider Self.
Eider is not a medical provider. It does not provide medical advice, diagnosis, or treatment. Nothing in Eider should be interpreted as a recommendation regarding your or your child's health. Always consult a licensed healthcare professional for medical decisions.
02Who can use Eider
You must be 18 years of age or older to create an account. By using Eider, you confirm you are an adult and the parent or legal guardian of any children whose information you enter.
03Your responsibility for accuracy
You are responsible for the accuracy of all information you enter. Eider records are only as accurate as what you provide. Do not use Eider as a substitute for official medical records maintained by your healthcare providers.
04Connected health records
If you connect a health system account (such as Epic MyChart), you authorize Eider to import your health records as described in our FHIR Data Use page. You are responsible for ensuring your health system credentials are yours to use. You can disconnect and delete imported records at any time.
05Caregiver sharing
When you share a caregiver link or add someone to Care Circle, you take responsibility for choosing who receives that access. Recipients should understand that Eider records are user-entered and have not been verified by a healthcare provider.
06No warranties
Eider is provided "as is" without warranties of any kind. We do not warrant that the app will be error-free or uninterrupted. To the fullest extent permitted by law, Eider and its operators are not liable for any damages arising from your use of or inability to use the app, including reliance on information recorded in the app.
07Your data
You own your data. See our Privacy Policy for how we store, protect, and handle your information.
08Acceptable use
You agree not to:
- Store information about individuals without their knowledge or consent (other than your minor children).
- Attempt to reverse engineer, copy, or redistribute the Eider application.
- Use Eider for any unlawful purpose.
09Appointment notes & audio features
Eider includes an optional Appointment Notes feature that uses your device microphone to transcribe spoken conversation during healthcare visits. By activating this feature, you agree to the following.
Your consent obligations
- You are solely responsible for obtaining the informed consent of all parties present before activating this feature, in compliance with all applicable federal, state, and local laws.
- Recording consent laws vary by jurisdiction. Many states require all parties to consent before a conversation may be recorded. You are responsible for knowing and complying with the laws of your location.
- Your healthcare facility or provider may have its own policies that prohibit recording regardless of applicable law. You must comply with those policies before using this feature.
How audio is handled
- Audio is transmitted securely, transcribed, and permanently deleted from Eider's servers immediately after transcription. Eider does not retain audio recordings.
- Only the written summary generated from the transcript is stored in your private account.
- Eider does not sell, share, or transmit your audio or appointment summaries to third parties.
Prohibited uses
- You may not use this feature to record any person without their knowledge and consent.
- You may not use this feature for surveillance, unauthorized monitoring, or any purpose that violates applicable law.
- You may not represent AI-generated appointment summaries as official medical records, clinical documentation, or legal evidence.
Accuracy of AI-generated summaries
Appointment summaries are generated by artificial intelligence and may be incomplete, inaccurate, or missing important information. They are for personal reference only. Always verify critical details with your healthcare provider and do not make medical decisions based solely on an AI-generated summary.
Eider expressly prohibits the use of this feature for any unauthorized recording or covert surveillance. Any liability arising from your use of this feature in violation of applicable law, facility policy, or these terms rests solely with you. Eider Health LLC shall not be liable for any claim, loss, or damage arising from unauthorized recording or misuse of appointment summaries.
10Changes to these terms
If we make material changes, we will notify you within the app and ask you to re-acknowledge before continuing to use Eider.
11Governing law
These terms are governed by the laws of the State of Texas.
